TERMS AND CONDITIONS AGREEMENT

This document sets forth the terms and conditions (the "Agreement") governing the relationship between the User ("User") and Hostelbay ("Hostelbay") in connection with the User's access to and use of Hostelbay's platform and services (the "Services").

1. ACCEPTANCE OF TERMS AND CONDITIONS

1.1. Hostelbay agrees to provide the Services to the User, and the User agrees to avail of the Services, in accordance with this Agreement, the Terms and Conditions, and Hostelbay's Privacy Policy, which collectively constitute the agreement between the parties ("Agreement").

1.2. By accessing the Hostelbay platform ("Site") or availing of the Services, the User acknowledges acceptance of this Agreement, which supersedes all prior arrangements, agreements, and understandings between the parties regarding the Services.

1.3. The User represents and warrants that they: i. are at least 18 (eighteen) years of age; and ii. possess the legal capacity to enter into and perform obligations under this Agreement. Hostelbay shall not be responsible for verifying the User's age or legal capacity. Minors may access the Site only under parental or legal guardian supervision.

2. ACCESS TO THE SITE

2.1. First-time Users may browse the Site without creating an account. However, access to certain functionalities requires account registration.

2.2. The User agrees to provide accurate and complete information when registering an account ("Account") and to comply with Hostelbay's verification procedures, including one-time password authentication.

2.3. A single mobile number may be used for only one Account. Hostelbay reserves the right to verify and take action, including account suspension, against Users operating multiple Accounts.

2.4. The User shall cooperate with Hostelbay personnel as required to facilitate access to the Site and Services.

3. SUBSCRIPTION PLANS

3.1. Hostelbay offers subscription-based Services, which the User may purchase upon payment of the applicable fees.

3.2. All subscription fees are non-refundable.

3.3. Hostelbay reserves the right to revise subscription fees at any time, including during the subscription period. Users will be notified of fee changes and shall pay any differential amount if applicable.

4. USER INFORMATION

4.1. Hostelbay is not responsible for the accuracy, integrity, legality, or reliability of any information provided by the User ("User Information").

4.2. Hostelbay reserves the right to remove, modify, or withhold access to any User Information at its sole discretion.

4.3. Hostelbay may retain or verify User Information but does not undertake any obligation to do so.

5. HOSTELBAY'S RIGHTS

5.1. Hostelbay may suspend, deactivate, or terminate User Accounts for violations of this Agreement, applicable laws, or any activity deemed detrimental to the Site's operation.

5.2. Hostelbay reserves the right to verify User Information to prevent brokers from accessing the Site. Detected broker Accounts may be disabled without cause.

5.3. Hostelbay may modify, suspend, or terminate any part of the Services, features, or structure without prior notice.

5.4. Hostelbay may issue notifications or promotional communications, which Users can unsubscribe from at their discretion.

6. UNAUTHORIZED ACCESS

6.1. The User is responsible for safeguarding their Account credentials and is liable for all activities conducted through their Account.

6.2. Users are encouraged to regularly update their passwords to enhance security.

7. NATURE OF HOSTELBAY PLATFORM

7.1. Hostelbay operates as a facilitator for interactions between Users. It does not endorse or verify Users or property listings on the Site.

7.2. Users are solely responsible for their interactions, and Hostelbay shall not be liable for disputes, fraudulent activities, or deficiencies arising from such interactions.

8. CONTENT ON THE SITE

8.1. Users shall not: i. Attempt unauthorized access to the Site or its systems. ii. Violate intellectual property rights. iii. Upload harmful software or engage in prohibited conduct. iv. Interfere with the integrity or performance of the Services.

8.2. Hostelbay reserves the right to monitor, edit, or remove any content deemed inappropriate or unlawful.

9. USER-GENERATED CONTENT (UGC)

9.1. Hostelbay does not claim ownership of UGC but reserves the right to use, edit, or remove such content.

9.2. Users shall bear sole liability for the consequences of their UGC.

10. INTELLECTUAL PROPERTY

10.1. Users shall not infringe upon Hostelbay's intellectual property rights or those of third parties.

10.2. Hostelbay reserves the right to initiate legal action for any infringement of its intellectual property.

11. OPERATIONAL HAZARDS

11.1. Hostelbay does not guarantee the Site's immunity from technical issues, including viruses or operational hazards, and disclaims liability for any resulting damages.

12. DISCLAIMER

12.1. Hostelbay provides the Site and Services on an "as-is" basis without warranties of any kind.

12.2. Users are encouraged to perform independent verifications before engaging with other Users or relying on Site information.

13. LIMITATION OF LIABILITY

Hostelbay's total liability under this Agreement shall not exceed the fees paid by the User for the Services giving rise to such liability.

14. AMENDMENTS

14.1. Hostelbay reserves the right to modify this Agreement without prior notice. Users' continued use of the Site constitutes acceptance of such modifications.

Shipping & Delivery Policy

For International buyers, orders are shipped and delivered through registered international courier companies and/or International speed post only. For domestic buyers, orders are shipped through registered domestic courier companies and /or speed post only. Orders are shipped within 1–2 days or as per the delivery date agreed at the time of order confirmation and delivering of the shipment subject to Courier Company / post office norms. HOSTELBAY is not liable for any delay in delivery by the courier company / postal authorities and only guarantees to hand over the consignment to the courier company or postal authorities within 1–2 days from the date of the order and payment or as per the delivery date agreed at the time of order confirmation.
